Did Dr. Frasch lie about his wife’s drinking?




Dr. Frasch told investigators that his wife had been drinking throughout their last day together and that she had opened a fresh bottle of champagne when they had gotten home that night. 


However, the toxicology report showed no alcohol in her system.


In the trial, both medical examiners were asked if Samira had finished off two bottles of champagne from about midnight to 4 am would there still be any alcohol in her system in the morning? Both the State medical examiner and the expert for the defense said there would still be alcohol in her system. 


However, Dr. Frasch had not told investigators that she had consumed two full bottles of champagne between midnight and 4 am. He had told them he had seen two empty champagne bottles on the kitchen counter when he had left that morning. And that her drinking had started earlier in the day. It was a second bottle that had been opened at midnight.


Earlier in the trial, Detective Justin Vann was asked why police had not collected the champagne bottles as evidence. Especially since there were so many open bottles everywhere, including a half-finished glass on an end table. Detective Vann said they didn’t because “there’s no law against that” regarding drinking. 


No, but there was no law against anything else they collected as evidence that day to try to determine what had happened. Even the diaper bag was temporarily confiscated. 


Considering how many crimes are fuelled by alcohol, it was odd that they didn’t collect them. It would have confirmed Doc’s story to have found Samira’s fingerprints on the bottles and the glass. He said he hadn’t been drinking. 


The truth is, with Dr. Frasch as the prime suspect from Day 1, they had no reason to verify his story or do any kind of detective work that might actually exonerate him. Finding evidence that pointed away from him was not in the best interest of their case. 


In addition, the prosecution was saying that Samira had died sometime much earlier, before Dr. Frasch left at 8 am. In fact, all the evidence pointed to her dying at around 11 am which gave more time for the alcohol to leave her body.
